    GST Virus More Dangerous Than Coronavirus: Senior Advocate Argues Over Portal’s Technical Glitches

    Senior Advocate Dr. Ashok Saraf led by a team of lawyers on January 4th, 2020 appeared before the Gauhati High Court in a PIL hearing filed by the Federation and Tax Bar Association in regard to filing of Form GSTR 9(annual return) and GSTR 9C(reconciliation form) and argued that “GST virus is more dangerous than coronavirus and the same has affected all the small traders of the country including the CA and tax practitioners”.

    The team which appeared for a motion hearing of the technical glitches and non-functioning of GST portal before a division bench of the Gauhati High Court comprising the Chief Justice Ajay Lamba and Justice Soumitra Saikia sought extension of date of filing of these forms or allow the petitioner to submit the same without payment of a late fee.

    Dr Saraf referred to various screenshots of GST portal to convince the Court that the “GST portal is non-functional most of the time and submitted that some unscrupulous person  might be involved so that they may take advantage by taking GST refunds.”

    The HC observed that as the date has already been extended, no interim order can be passed. However the court directed the petitioners to submit a representation to the authority via e-mail and a copy shall be given to SC Kayal, ASG seeking an extension of time for 30 days.
